Tenth House Management - Terms & Conditions for Client Bookings

These Terms and Conditions (“Terms”) apply to all bookings of Talent through Tenth House Talent Management Ltd (“Tenth House”, “we”, “us”, or “the Agency”). By confirming a booking with us, you (“the Client”) agree to be bound by these Terms.

Acceptance of Terms

By proceeding with a booking (whether or not a signed booking confirmation form is returned), the Client agrees to be bound by these Terms & Conditions.

Any proposed changes to the booking confirmation must be agreed in writing by Tenth House before the booking begins. For repeat bookings with consistent terms, a new confirmation may not be required.

1. Bookings & Confirmations

1.1. All bookings must be confirmed in writing by the Client via email or signing of the booking confirmation form. If a signed confirmation form is not returned but the booking proceeds, these Terms will be deemed accepted.

1.2. Any amendments to a booking confirmation must be agreed in writing by Tenth House before the booking commences. We reserve the right to decline any amendments that materially change the nature of the booking.

1.3. For repeat bookings of the same Talent under similar terms, written reconfirmation may be waived at our discretion.

2. Fees, Rates & Usage

2.1. Booking Fees

Unless otherwise agreed in writing, standard bookings cover the Talent’s time and performance only. Usage of the Talent’s image, name, voice, likeness or performance for any promotional, advertising, or commercial purpose must be agreed and paid for separately.

2.2. Permitted Use (Time & Territory)

Unless otherwise stated in the booking confirmation, permitted usage is:

  • For a single agreed medium (e.g. web, digital, print)

  • For 12 months

  • In the UK only

Use outside these terms (e.g. extended usage, additional territories, multiple platforms) must be negotiated and may be subject to additional fees.

2.3. A.I & Biometric Use - Restriction

Use of any image, video, or audio recording of the Talent for:

  • AI training,

  • Biometric profiling,

  • Synthetic media or deepfakes,

is strictly prohibited without prior written consent. Breach of this condition may result in legal action and/or damages.

3. Rates & Overtime

3.1. Day / Hourly Rates

  • Standard bookings run Monday to Friday between 9:00am and 6:00pm.

  • Bookings exceeding 5 hours are billed at a full day rate unless agreed otherwise.

  • Rates will be outlined clearly in your booking confirmation.

3.2. Overtime

Overtime rates apply for:

  • Any time worked outside of standard hours

  • Saturdays (1.5x standard rate)

  • Sundays & Bank Holidays (2x standard rate)

3.3. Travel Time

Travel over 5 miles from Central London (measured from Oxford Circus) is chargeable at 50% of the Talent’s hourly rate for travel time.

4. Travel, Location & Additional Expenses

4.1. Clients must arrange and cover necessary transport to and from location shoots. If not provided, we will arrange travel and recharge the cost plus a 12.5% admin fee.

4.2. If a model is required to travel or stay overnight, these costs must be approved in writing before being incurred. Talent will not be expected to pay upfront unless explicitly agreed.

4.3. Location bookings preventing Talent from attending other work (e.g. overnight shoots) may be charged at an additional holding fee.

5. Usage Fees (Including Social, Territory, and Exclusivity)

5.1. Usage Rights

Unless agreed otherwise in writing, the booking fee covers usage of the Talent’s image for a single medium, within the United Kingdom, for a period of 12 months from the date of the booking. Usage must be confirmed and paid in full before the content can be used.

5.2. Additional Usage

If the Client wishes to use the Talent’s image beyond the scope of the original booking — for example, in other media formats, territories, or for longer than 12 months — this must be negotiated in advance and may incur an additional fee.

5.3. Social Media

Social media usage is not automatically included in digital or web rights and must be agreed separately. This includes, but is not limited to, brand-owned social accounts, paid social campaigns, or reposting Talent content.

5.4. Territory

Any use of the Talent’s image outside the UK (including global campaigns or region-specific rollouts) must be approved in writing and may be subject to additional territory fees.

5.5. Exclusivity

If the Client requires category or brand exclusivity (e.g. skincare, sportswear, fragrance), this must be negotiated prior to the booking. Additional exclusivity fees will apply. Without this, the Talent may work with competing or similar brands.

6. Agency Fees & VAT

6.1. Booking Fees
All Talent fees are subject to an agency commission of 20%, which will be added to the final invoice unless agreed otherwise.

6.2. VAT
All fees and charges (including commission and usage fees) are exclusive of VAT, which will be applied where applicable. Clients are responsible for the full amount, including VAT, and may not withhold or deduct this from payments.

6.3. Fee Breakdown
Unless otherwise agreed in writing, agency invoices are issued as a combined fee, inclusive of both Talent fees and agency commission. This ensures clear, upfront costings for all bookings.

7. Invoicing & Payments

7.1. Invoicing
Invoices are issued on the next working day after the final day of a booking. For multi-day bookings, the invoice is sent after the last consecutive day.

7.2. Payment Terms
Standard payment terms are 30 days from the invoice date. The Client agrees to ensure that payment is processed and approved within this period.

7.3. Late Payment
Tenth House reserves the right to charge interest on overdue invoices at 5% above the Bank of England base rate, compounded daily.

7.4. Responsibility for Payment
Unless otherwise agreed in writing, the party confirming the booking will be considered the Client and is solely responsible for payment. If acting on behalf of another party (e.g. brand or production company), both parties may be held jointly and severally liable for fees.

7.5. Usage & Payment
Usage rights are not granted until full payment has been received. If payment is delayed, the Talent’s image must not be used until this is resolved.

8. Cancellations

8.1. Cancellation by the Client

If a confirmed booking is cancelled by the Client, the following will apply:

  • Within 48 hours of the booking: up to 100% of the agreed fee may be payable.

  • Between 2–5 working days’ notice: up to 50% of the agreed fee may be payable.

  • More than 5 working days’ notice: no cancellation fee will apply.

Where possible, if the booking is rescheduled or the Talent is rebooked for alternative work of a similar value, cancellation fees may be reduced or waived at the Agency’s discretion.

If the Talent has already incurred reasonable, pre-approved costs (such as travel or preparation), these may still be chargeable with supporting documentation.

Our aim is always to be fair and flexible, and we’ll work with Clients in good faith to minimise disruption wherever possible.

8.2. Weather-related Cancellations

  • First cancellation: 50% of the fee will be charged unless the Client cancels in time to prevent the Talent from travelling or arriving on site, in which case no fee will apply.

  • Subsequent cancellations: 100% of the fee will be charged.

8.3. Cancellation by the Agency
If the Agency must cancel a booking (due to unforeseen circumstances or Talent unavailability), we will:

  • Notify the Client as early as possible

  • Endeavour to provide a suitable replacement

  • Assist in rescheduling the shoot where possible

The Agency accepts no liability for cancellations beyond our control and recommends Clients hold appropriate insurance cover.

9. Model Welfare & Saftey

9.1. Client Responsibilities
The Client must ensure the safety, welfare, and dignity of the Talent at all times. This includes:

  • Providing a safe working environment that complies with all health and safety standards.

  • Respecting the Talent’s personal boundaries, privacy, and professional status.

  • Ensuring adequate breaks, refreshments, and a private changing space.

  • Not requesting the Talent perform any activity that is unsafe, degrading, or outside the agreed scope of work.

9.2. Travel & Accommodation
Where overnight stays or long-distance travel are required, the Client must provide or cover the cost of travel and accommodation. These arrangements must be agreed in advance and approved by the Agency and Talent.

9.3. Insurance
Clients are responsible for ensuring suitable insurance is in place to cover risks including:

  • Accidents or injuries during the booking

  • Travel-related incidents

  • Loss of income due to cancellation or rescheduling

9.4. Credit and Attribution
Wherever possible, the Talent should be credited as “[Model Name] @ Tenth House Management” on published content.

10. Usage of Talent Images / AI Clause

Unless otherwise agreed in writing, Talent images (including stills, video, or likeness) may not be used for the training, development or deployment of AI systems, including but not limited to deepfakes, generative AI tools or biometric data processing.
Unauthorised use may result in legal action and the Client will be liable for all associated damages and costs.

11. Intellectual Property & Credits

All rights to images or footage remain with the Talent and the Agency unless explicitly assigned. No images, videos, or likenesses may be used beyond the agreed usage terms without prior written approval.

Where credits are used, the format must be:
Talent Name @ Tenth House Management

12. General Provisions

12.1 Governing Law & Jurisdiction
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.

12.2 Entire Agreement
These Terms & Conditions, together with the signed Booking Confirmation and any written amendments agreed by both parties, constitute the entire agreement between the Agency and the Client.

12.3 Amendments & Variations
No variation of these terms will be valid unless agreed in writing and signed by an authorised representative of Tenth House Management.

12.4 Severability
If any clause of this agreement is found to be unenforceable, the remaining clauses will remain valid and enforceable.
